California County Changes Zoning To Stop Gun Shop From Opening

I’ve said it time and again that California is the land of nuts, fruits and flakes and one of the most liberal states in the county. Just consider the fact that it is home to the 9th Circuit Court of Appeals, the most anti-Christian, anti-family and anti-U.S. Constitution court in the land AND it is home to Rep. Nancy Pelosi.

In keeping with the state’s reputation, Alameda County Board of Supervisors has abused their powers to prevent three businessmen from opening a gun shop. Located on the east side of San Francisco Bay with a population of 1.5 million residence, Alameda County is one of the ten most populated counties in the state of California.

In 2010, Gary Gamaza, Steve Nobriga and John Teixeira formed a partnership and set out to open a gun shop in Alameda County. They followed all of the laws and zoning requirements and applied for the necessary permits. One of the county’s zoning requirements for a gun shop was that it had to be more than 500 feet from any private residence, school or liquor store. When the three partners found the location they wanted, they carefully measured distances to the nearest private residences and insured that they met the distance ordinance and even had a buffer distance to boot.

The West County Board of Zoning Adjustments voted to give the three men a conditional use permit which would allow them to proceed with their plans to open the gun shop. After the zoning approval was granted, the Alameda County Board of Supervisors changed the distance requirement for gun shops, putting the location of the new store in violation and permits were denied. Additionally, it seems that the Board of Supervisors allowed a homeowners association to file an appeal in regard to the zoning permission granted for the gun store after the deadline for appeals had expired.

Gamaza, Nobriga and Teixeira have recently filed a lawsuit against Alameda County and their Board of Supervisors for intentionally violating their 14th Amendment rights of equal protection and due process. The Second Amendment Foundation, Calguns Foundation and California Association of Federal Firearms Licensees have joined the lawsuit against the county and supervisors. According to Alan Gottlieb, founder and executive vice president of the Second Amendment Foundation, commented about the case saying:

“This is a violation of their rights of equal protection and due process under the Fourteenth Amendment, and cannot be allowed to stand. Social bigotry is bad enough when practiced by the media and the gun prohibition lobby but when it becomes the official policy of an elected government panel, it then becomes necessary, if not imperative, for the courts to intervene.”

Hopefully, the U.S. District Court for the Northern District of California, where the lawsuit has been filed, is not as liberal as the rest of the region and will rule on law and not liberal agendas.

How can they do something similar to a church? Got any references?

This is probably the third or fourth zoning story from CA I've seen in the last couple of months. I'm a news whore, what can I say.

it obiviously a case of "We Don't Like You" illness
hopefully a judge will follow the book and not the politics
if your on thier team it doesnt matter what zoneing says they will "waiver" it for you and of course a healthy "donation" to Thier favorite charity
and it breezes right thru
look at zoning in "Bloodshed City"il,
rush street tavern just takes over the city sidewalk to make a patio
now people have to walk in the street whitch is too narrow to begin with
no permit no zoneing when asked the owner said he "talked" the aldercreature and it went right thru talk= $$
they might win but i 'll wager the county board and city will make them "Pay Thru The Nose" to get it with court costs and paperwork
and be harrassing them with making sure they check permits and fees and taxes and of the course the all time favorite,.. surprise building inspections
