The ordinance as passed... Enjoy...
Shall Pike County, Illinois adopt the “Constitutional Carry of Arms” ordinance as follows?
CONSTITUTIONAL CARRY OF ARMS
WHEREAS: the Second Amendment to the United States Constitution states “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed;”
WHEREAS: Article 1 Section 24, of the Illinois Constitution states “The enumeration in this Constitution of certain rights shall not be construed to deny or disparage others retained by the individual citizens of the State;”
WHEREAS: the Supreme Court of the United States has held in District of Columbia et al. v. Heller, that the “right to keep and bear arms” is an individual and fundamental right protected by the Second Amendment to the United States Constitution;
AND WHEREAS: the Supreme Court of the United States has held in McDonald et al. v. City of Chicago, Illinois, et al., that the Second Amendment to the United States Constitution applies to the states;
NOW THEREFORE BE IT ENACTED as the law of Pike County, Illinois, that the people have an individual and fundamental right to keep and bear arms free of infringement by any local, state, or federal government; AND FURTHER, that the method or manner of possessing, carrying, or transporting said arms shall not be infringed. THIS ORDINANCE SHALL EXCLUDE: all individuals who are prohibited from possessing firearms under the laws of the United States, prohibited minors, and those under any intoxicating influence exceeding the standards of the Illinois Motor Vehicle Code. Upon passage this ordinance shall be in full force and effect. |

If it takes one county at a time, so be it.
The rest of Illinois will be looking at what happens in Pike county on this very important issue that concerns us. |

The States Attorney will need to put out a press release telling his stand on this at some point.... Let's hope sooner rather than later....

Am I reading this right? Pike county has legalised carry?. Does that not go against illinois state law?. Wow what a step forward. |

Ok... No surprise... the statement is from the Sheriff Paul F. Petty and ISP Lt. Brad Lacey.... There is another step in the process if it were to become an actual law. According to the States Attorney the "Question," is advisory, which for everyone's benefit reads, "Shall Pike County, Illinois adopt the "Constitutional Carry of Arms" ordinance as follows?"
So it would have one more step in the process...
Everyone is still ECSTATIC!!!! As far as I am concerned it is a poke in the eye of the thieves of Liberty!!!!!!! This thing is gonna break our way hopefully THIS YEAR!

RE: Constitutional Carry of Arms in Pike County
Following the most recent vote regarding the issue of the Constitutional Carry of Arms in Pike County; I have received numerous inquiries on this topic. Many persons have inquired if they can carry today? Others have asked what is the next step in the Process? And some have indicated they are confused on what exactly it means for us in Pike County.
I would like to take this opportunity to address the issue as a whole and particularly clear up any confusion or misunderstanding regarding the most recent victory.
First of all, the initiative to put this question on the ballot was to, in fact, determine that support exists with voters regarding the Conceal-Carry issue. Obviously, the vote has cleared that up in an overwhelming manner.
Secondly, the placing of this topic on the ballot is only the beginning of the process to have Constitutional Carry of Arms in Illinois. We can't ignore our current State legislation that controls or prohibits carrying concealed weapons. As to this question, Illinois law states as follows: "Local questions of public policy... shall be advisory public policy questions, and no legal effects shall result from the adoption or rejection of such proposition." Thus, although there is overwhelming support for
some form of Open/and-or Conceal-Carry in Pike County, there will be no change in the status quo until our legislators take this message to Springfield.
Though Counties can establish more restrictive laws; the Counties shall not create laws which contradict or supercede (sic) current State laws. However, at the present time with the State of Illinois still not supporting an Open and/or Conceal-Carry Law, a person is subject to being arrested for a felony offense if this person is in violation of Illinois Law regardless of any initiative passed in this County.
Perhaps one of the largest steps toward Carry-Conceal Laws in Illinois took place in our voting booths on Tuesday, March 21,2012, in Pike County, Illinois. However, a step backwards would be the attention we would get from law abiding citizens to directly violate the State Law or ignore this argument and immediately begin to carry concealed weapons in violation of our current laws. The success of the vote in the last election is yet to come; under no circumstances should we hinder what so many have worked so hard to earn in putting this issue at the forefront of Illinois Politics. Our vote does not allow us to carry a concealed weapon off our own property. It is simply a big step towards such.
The argument is not over. If you wish to support Dr. Mefford's effort, continue to stand fast in support of this work and do not attempt to circumvent the process or ignore your obligations as citizens who wish to be heard throughout the State and Nation. If you support this initiative, you need to continue to support persons like Dan Mefford and others who are fighting this fight. Encourage your friends in
other counties to gather support the way Pike County has with this resolution.
In the event you wish to educate yourself on the current gun laws, now would be the perfect time to do so. Let's be educated and aware, it makes for an easier argument. |
