UNIONDALE, N.Y. (CBS 2) — He was arrested for protecting his property and family.

But it’s how the Long Island man did it that police say crossed the line.

He got an AK-47 assault rifle, pulled the trigger and he ended up in jail, reports CBS 2’s Pablo Guzman.

George Grier said he had to use his rifle on Sunday night to stop what he thought was going to be an invasion of his Uniondale home by a gang he thought might have been the vicious “MS-13.” He said the whole deal happened as he was about to drive his cousin home.

“I went around and went into the house, ran upstairs and told my wife to call the police. I get the gun and I go outside and I come into the doorway and now, by this time, they are in the driveway, back here near the house. I tell them, you know, ‘Can you please leave?’ Grier said.

Grier said the five men dared him to use the gun; and that their shouts brought another larger group of gang members in front of his house.

“He starts threatening my family, my life. ‘Oh you’re dead. I’m gonna kill your family and your babies. You’re dead.’ So when he says that, 20 others guys come rushing around the corner. And so I fired four warning shots into the grass,” Grier said.

Police determined Grier had the gun legally. He has no criminal record. And so he was not charged for the weapon.

If He was outnumbered at about 20:1 as reported and they were threatening him and trespassing, I believe he showed considerable restraint. Especially if more than one was within 21 feet of him. In my neighborhood there would have been more than one body.

lol most definetly, if you own an AK and you NEED to use it especially when it comes to this many people, i think its a bad case for him to get charged w/ anything. He was defending himself

Only thing that i don't agree with in this story are the "warning shots" fired...I'm fine with him using the AK, just don't fire any shots unless he is going to be putting someone down. I'm proud of this guy for defending his home/family regardless...I may have snapped if they said they were going to kill my family and my kids, and just started picking them all off....

Yeah, warning shots aren't a great idea. I also don't like him asking them "can you please leave" but it's a tense situation. I'm glad that it ended without bloodshed, as I'm sure he would rather not have anyone's death, even a gang-banger's, on his hands. I hope that the charges are dropped though.

We all have to look at this from the viewpoint of the NEW YORK state Castle Doctrine. Their law is not as strong as some other states. In NY what he did MAY have been conceived as being an illegal discharge of a firearm, brandishing, etc.

Different states have different laws.

Was talking to my buddies at work about this, a part of me wants to see what would happen if he woulda just opened fire on them , would the cops give him a handshake and a wink?

Cop shows up , looks at his partner after he runs the names

Ok we got 12 outstanding warrants, we have 4 5 time criminals , repeat offenders, and all other things.

Something tells me out of all those gang members , I doubt a single one would come out clean.

Not saying he should have or I would have ( unless just cause ) but just one of those what if.

i will have to agree about the warning shots, bad idea imho. if you pull the trigger make sure you hit someone your aiming at if not dont bother discharging...but thats just me.

agreed, warning shots are just misses in the court's eyes i'm guessing.
