Walter Maksym, ICarry.org's constitutional attorney, was interviewed on ABC 7 regarding a lawsuit against the gun manufacturer Beretta. A young boy and a friend accessed a loaded firearm. They first removed the magazine, but a round was in the chamber, and while playing with it the friend fired and shot the boy in the abdomen. He later died of the wound.
It's saddening when things like this happen. Fortunately they happen very seldom, but there is still a need to prevent it. These incidents can be prevented by ensuring firearms are kept out of reach and access by unauthorized people like children. Children should also be taught firearm safety. The more firearm safety is taught, the safer children become by knowing what to do and what not to do if they should ever find a gun.
Unfortunately these two steps were not taken in this incident. Instead of accepting the responsibility for this tragedy, the family members tried to sue the manufacturer of the firearm. The pistol did not malfunction. Pistols are designed to fire when they are loaded and the trigger is pressed. This is common knowledge and is why firearm safety is so important, and it is so important to ensure unauthorized people do not gain access to firearms.
No new laws would prevent this. Only responsible people can prevent things like this, and responsibility cannot be legislated into existence. The family members have paid enough - no one deserves to go to prison over this terrible accident. But the rights of those firearms owners who are responsible should not be curtailed nor dependent upon the actions of a handful of irresponsible people. This person was obviously irresponsible not only by leaving a gun out, but also by trying to blame a company who makes a product (which functioned as designed). |

| Federal Firearms Laws Fraud Revealed |

The Federal Government has no constitutional authority to regulate firearms. How then have all these federal laws been passed and enforced? What about all the new laws that are always hanging over the heads of tens of millions of peaceful gun owners?
